ofvessel,quantitytobeloadedandthenameofshippingagent,soastoenabletheSellertocontacttheshippingagentdirectandarrangetheshipmentofthegoods.TheSellershalladvisebycableortelexintimetheBuyeroftheresultthereof.Should,forcertainreasons,itbecomenecessaryfortheBuyertoreplacethenamedvesselwithanotherone,orshouldthenamedvesselarriveattheportofshipmentearlierorlaterthanthedateofarrivalaspreviouslynotifiedtotheSeller,theBuyeroritsshippingagentshalladvisetheSellertothiseffectinduetime.TheSellershallalsokeepinclosecontactwiththeagentortheBuyer.14.5ShouldtheSellerfailtoloadthegoodsonboardortodeliverthegoodsunderthetackleofthevesselbookedbytheBuyer.WithinthetimeasnotifiedbytheBuyer,afteritsarrivalattheportofshipmenttheSellershallbefullyliabletotheBuyerandresponsibleforalllossesandexpensessuchasdeadfreight,demurrage.Consequentiallossesincurreduponand/orsufferedbytheBuyer.14.6Shouldthevesselbewithdrawnorreplacedordelayedeventuallyorthecargobeshutoutetc.,andtheSellerbenotinformedingoodtimetostopdeliveryofthecargo,thecalculationofthelossinstorageexpensesandinsurancepremiumthussustainedattheloadingportshallbebasedontheloadingdatenotifiedbytheagenttotheSeller(orbasedonthedateofthearrivalofthecargoattheloadingportincasethecargoshouldarrivetherelaterthanthenotifiedloadingdate).Theabovementionedlosstobecalculatedfromthe16thdayafterexpiryofthefreestoragetimeattheportshouldbebornebytheBuyerwiththeexceptionofForceMajeure.However,theSellershallstillundertaketoloadthecargoimmediatelyuponthecarryingvesselsarrivalattheloadingportatitsownriskandexpenses.Thepaymentoftheafore-saidexpensesshallbeeffectedagainstpresentationoftheoriginalvouchersaftertheBuyersverification.【章名】15C&FTerms15.1TheSellershallshipthegoodswithinthetimeasstipulatedinclause8ofthisContractbyadirectvesselsailingfromtheportofloadingtoChinaport.TranshipmentonrouteisnotallowedwithouttheBuyerspriorconsent.ThegoodsshallnotbecarriedbyvesselsflyingflagsofcountriesnotacceptabletothePortAuthoritiesofChina.15.2ThecarryingvesselcharteredbytheSellershallbeseaworthyandcargoworthy.TheSellershallbeobligedtoactprudentlyandconscientiouslywhenselectingthevesselandthecarrierwhencharteringsuchvessel.TheBuyerisjustifiedinnotacceptingvesselscharteredbytheSellerthatarenotmembersofthePICLUB.15.3ThecarryingvesselcharteredbytheSellershallsailandarriveattheportofdestinationwithinthenormalandreasonableperiodoftime.Anyunreasonableaviationordelayisnotallowed.15.4TheageofthecarryingvesselcharteredbytheSellershallnotexceed15years.Incaseherageexceeds15years,theextraaverageinsurancepremiumthusincurredshallbebornebytheSeller.Vesselover20yearsofageshallinnoeventbeacceptabletotheBuyer.15.5Forcargolotsover1,000M/Teach,oranyotherlotslessthan1,000metrictonsbutidentifiedbytheBuyer,theSellershall,atleast10dayspriortothedateofshipment,informtheBuyerbytelexorcableofthefollowinginformation:thecontractnumber,thenameofcommodity,quantity,thenameofthecarryingvessel,theage,nationality,andparticularsofthecarryingvessel,theexpecteddateofloading,theexpectedtimeofarrivalattheportofdestination,thename,telexandcableaddressofthecarrier.15.6Forcargolotsover1,000M/Teach,oranyotherlotslessthan1,000metrictonsbutidentifiedbytheBuyer,theMasterofthecarryingvesselshallnotifytheBuyerrespectively7(seven)daysand24(twenty-four)hourspriortothearrivalofthevesselattheportofdestination,bytelexorcableaboutitsETA(expectedtimeofarrival),contractnumber,thenameofcommodity,andquantity.15.7IfgoodsaretobeshippedperlinervesselunderlinerBillofLading,thecarryingvesselmustbeclassifiedasthehighest____________orequivalentclassaspertheInstituteClassificationClauseandshallbesomaintainedthroughoutthedurationoftherelevantBillofLading.Nevertheless,themaximumageofthevesselshallnotexceed20yearsatthedateofloading.Thesellershallbeartheaverageinsurancepremiumforlinervesselolderthan20years.Undernocircum-stancesshalltheBuyeracceptvesselover25yearsofage.15.8Forbreakbulkcargoes,ifgoodsareshippedincontainersbytheSellerwithoutpriorconsentoftheBuyer,acompensationofacertainamounttobeagreeduponbybothpartiesshallbepayabletotheBuyerbytheSeller.15.9TheSellershallmaintainclosecontactwiththecarryingvesselandshallnotifytheBuyerbyfastestmeansofcommunicationaboutanyandallaccidentsthatmayoccurwhilethecarryingvesselisonroute.TheSellershallassumefullresponsibilityandshallcompensatetheBuyerforalllossesincurredforitsfailuretogivetimelyadviceornotificationtotheBuyer.
